1. Acceptance of Terms

By accessing, browsing, or using VOD Loader ("the Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with these terms, you must immediately discontinue use of the Service.

2. Service Description

VOD Loader is a browser-based tool that allows users to download publicly accessible video content from supported streaming platforms. The Service acts as an intermediary and does not host, store, or distribute any video content on its own servers. A separate server-assisted cloud download feature ("Cloud Download") is available as an add-on via Cheese credits.

4. Cloud Download Feature (Cheese Credits)

Cloud Download is a separate, server-assisted download feature and is subject to the following terms:

• Cloud Download is not bundled as unlimited free usage in any subscription plan
• Cheese credits must be held to use Cloud Download; credits are consumed per job
• Monthly Pro subscribers receive 4 Cheese credits per billing month at no additional cost; these expire at month end if unused
• Yearly and Lifetime plan purchasers receive 1 Cheese credit on purchase
• Additional Cheese credits may be purchased separately at any time
• Cloud Download availability is subject to server capacity and infrastructure constraints; VOD Loader does not guarantee uninterrupted availability of this feature
• Cheese credits are non-refundable once used
• VOD Loader reserves the right to adjust Cheese credit pricing, issuance amounts, or feature availability with reasonable advance notice

5. Permitted Use

You may use this Service only for lawful purposes and in accordance with these Terms. Specifically, you agree:

• To use the Service for personal, non-commercial purposes only
• To only download content that you have the legal right to access and download
• To comply with all applicable copyright laws and respect intellectual property rights
• To obtain necessary permissions from content creators before downloading their content
• NOT to use downloaded content for commercial purposes without proper authorization
• NOT to redistribute, resell, or publicly display downloaded content without permission
• NOT to use the Service to violate any third-party rights

6. Copyright and Intellectual Property

User Responsibility: All downloaded content remains the exclusive property of the original content creators, copyright holders, and the respective platform. You are solely responsible for ensuring that your use of the Service and any downloaded content complies with applicable copyright laws and the terms of service of the original platform.

DMCA Compliance: We respect intellectual property rights. If you believe your copyrighted work has been downloaded or used in a way that constitutes copyright infringement, please contact us immediately with detailed information.

The Service does not claim any ownership rights over content downloaded through it. We do not monitor, verify, or control the content users choose to download.

7. Prohibited Activities

You agree NOT to:

• Use the Service to download private, password-protected, or unauthorized content
• Violate any applicable local, state, national, or international law
• Infringe upon or violate our intellectual property rights or the rights of others
• Harass, abuse, insult, harm, defame, or discriminate against others
• Attempt to bypass any security features or access controls of the Service
• Use automated systems (bots, scrapers) to access the Service excessively
• Interfere with, disrupt, or create an undue burden on the Service or networks
• Attempt to impersonate another user or person
• Engage in any commercial use without our express written permission

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

We do not warrant that:

• The Service will be uninterrupted, timely, secure, or error-free
• The results obtained from using the Service will be accurate or reliable
• The quality of any content, information, or materials obtained through the Service will meet your expectations
• Any errors in the Service will be corrected
• Cloud Download or Cheese credit features will be available at all times

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL VOD LOADER, ITS OPERATORS, AFFILIATES, OR SERVICE PROVIDERS BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or use
• Damages resulting from your use or inability to use the Service
• Any unauthorized access to or use of our servers and/or any personal information stored therein
• Any interruption or cessation of transmission to or from the Service
• Any bugs, viruses, trojan horses, or similar that may be transmitted through the Service by any third party
• Any legal consequences arising from your use of downloaded content
• Copyright infringement claims resulting from your downloads
• Loss or expiry of unused Cheese credits
• Unavailability of Cloud Download due to server capacity or infrastructure issues

YOU ASSUME ALL RESPONSIBILITY AND RISK FOR YOUR USE OF THE SERVICE AND ANY CONTENT YOU DOWNLOAD.

10. Indemnification

You agree to indemnify, defend, and hold harmless VOD Loader and its operators, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:

• Your use or misuse of the Service
• Your violation of these Terms of Service
• Your violation of any rights of another party, including copyright infringement
• Any content you download through the Service

11. Third-Party Services and Links

The Service may contain links to third-party websites or services that are not owned or controlled by VOD Loader. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services. Payments are processed by third-party providers (PayPal, Creem); VOD Loader does not store payment card information.

12. Payment and Refunds

All subscription and Cheese credit purchases are non-refundable except as required by applicable law. Payments are processed through secure third-party payment processors. Subscription plans may be subject to automatic renewal unless cancelled before the renewal date. VOD Loader reserves the right to modify plan pricing or features with reasonable advance notice. Continued use of the Service after a pricing change takes effect constitutes acceptance of the new pricing.

13. Account Termination

We reserve the right to suspend or terminate your access to the Service immediately, without prior notice or liability, for any reason, including but not limited to breach of these Terms. Upon termination, your right to use the Service will cease immediately. Any unused Cheese credits at the time of termination for breach are forfeited without refund.

14. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

15. Privacy

Your use of the Service is also governed by our Privacy Policy. Please review our Privacy Policy to understand our practices regarding your personal information.

16. Fair Use Notice

This Service is intended to be used in compliance with fair use principles and applicable copyright exceptions for personal, educational, or transformative purposes. Users must ensure their use qualifies as fair use under applicable law.

17. Governing Law

These Terms shall be governed and construed in accordance with applicable international laws, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

18. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions will remain in effect. These Terms constitute the entire agreement between you and VOD Loader regarding the Service.
